These Terms of Service (“Terms”) govern your use of services provided by GKUNDI DESIGNS (“Company”, “We”, “Us”, or “Our”). By engaging our services, visiting our website, or making a purchase, you (“Client”, “You”, or “Your”) agree to be bound by these Terms, our Refund & Cancellation Policy, and our Privacy Policy.
If you do not agree, please do not use our services.
1. Company Information

2. Scope of Services
We provide custom graphic design, branding, web design, and digital creative services. All work is tailored to each client’s brief and involves intellectual concepts, design time, and digital delivery.
3. Payments
All payments must be made in full before a project begins, unless otherwise agreed in writing.
All payments are non-refundable, in line with our Refund & Cancellation Policy.
Pricing for services is communicated before work begins.
4. Refunds & Cancellations
Our Refund & Cancellation Policy forms part of these Terms. By purchasing, you agree that:
Payments are 100% non-refundable once a project has started.
If you cancel, you forfeit all rights to the work completed.
Abandoned projects (no communication for 30+ days) are automatically canceled without refund.
Please review the full Refund & Cancellation Policy before engaging our services.
5. Client Responsibilities
To ensure smooth project delivery, you agree to:
Provide clear instructions, accurate information, and timely feedback.
Supply all necessary materials (e.g., logos, images, text) in a usable format.
Respond to communication promptly to avoid delays.
Not request work that violates any laws, infringes copyrights, or promotes harmful/illegal activity.
Delays caused by missing information, lack of feedback, or late approvals are not grounds for refunds.
6. Revisions & Scope of Work
Revisions are included to achieve reasonable satisfaction within the scope of the original brief.
Requests outside the agreed scope (new directions, additional concepts, or major changes) may require a new project and additional payment.
7. Intellectual Property
All creative work remains the property of GKUNDI DESIGNS until full payment is received.
Once full payment is made, the client receives usage rights to the final deliverables as agreed.
We reserve the right to showcase completed projects in our portfolio or marketing unless otherwise agreed in writing.
You may not resell, redistribute, or claim authorship of our work without explicit permission.
8. Digital Work & Delivery
All deliverables are digital files (logos, graphics, websites, branding materials, etc.).
Once delivered, digital work cannot be returned, and no refunds are possible.
We are not responsible for third-party issues (hosting downtime, printing errors, or misuse of files by others).
9. Privacy & Data Protection
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using our services, you consent to that policy.
10. Limitation of Liability
Our services are provided “as is” without guarantees of specific outcomes (e.g., sales increases, marketing performance).
We are not liable for indirect, incidental, or consequential damages (e.g., lost profits, business interruptions, third-party failures).
Our maximum liability is limited to the amount paid for the specific service in question.
11. Indemnification
You agree to indemnify and hold GKUNDI DESIGNS, its owners, and employees harmless against any claims, damages, or expenses arising from:
Misuse of our services or deliverables.
Violation of these Terms.
Infringement of third-party rights caused by content you provide.
12. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Kenya.
Any disputes will be subject to the exclusive jurisdiction of the courts in Kenya.
13. Changes to Terms
We may update or amend these Terms at any time without prior notice. Updates will be posted on our website with a new “Last Updated” date. Continued use of our services means you accept the revised Terms.
14. Final Acknowledgement
By purchasing, engaging, or using our services, you confirm that you have read, understood, and agreed to these Terms of Service, as well as our Refund & Cancellation Policy and Privacy Policy.
